Cheapseats.com, and the services of each of its modules, are offered exclusively by Travelogix Inc. ("Cheapseats.com") and/or its various third party providers and distributors. Its offer of such services are conditioned on the user's ("User") acceptance of the terms and conditions set forth herein and on other pages of the Cheapseats.com web site ("Site"). By accessing and using this Site or any of its services, User shall be deemed to have agreed to all the terms, conditions, and notices in this Site ("Agreement") without modification.
TRAVEL PURCHASE RESTRICTIONS
By placing an order the customer accepts the following restrictions:

Our booking engine allows you to book 24 hours prior to departure for domestic flights. International flights require a 3 day advance purchase. Many international airlines require paper tickets to be issued which require a 5 day advance.
Customers will receive a 2nd email confirmation within 24 hours once the ticket has been issued. Cheapseats.com will not be liable for any misdirected or undeliverable email. All correspondence from “Cheapseats.com” will be through the customer’s email listed on their personal profile.
Name on Reservations
All reservations must be made in the EXACT name of the person traveling - no nicknames. For international travel the name on the reservation must be EXACTLY as it appears on the traveler's passport. Airlines do not allow name changes.
General Restrictions
All flights should be confirmed with the airline directly as they may have last minute schedule changes. We recommend that you do so at least 24 hours prior to departure for domestic flights (72 hours for flights to Hawaii and international destinations).
In most cases, standby upgrades will not be permitted.
Many of our discounted tickets do not allow for Frequent Flyer Mileage accrual.
Seat assignments will be made at the airport on the day of departure or by contacting the airline directly.
Tickets will not be sold to unaccompanied minors age 18 and under. Tickets may be purchased for minors age 18 and under; however, they must be accompanied by an adult when traveling.
We reserve the right to cancel requests for High Security Risk Areas.
All customers are advised to know the entry requirements for the country(ies) to which they are traveling or entering. Reliable information regarding international travel can be found at travel.state.gov.
Cheapseats.com's sale of tickets to you does not imply any guarantee of passenger's ability to enter the country of destination. Traveler understands that Cheapseats.com, Inc. takes no responsibility for determining passenger eligibility to enter any specific country.
A passengers duty tax may be assessed upon departure from some international destinations such as Mexico, and the United Kingdom. This is the passengers responsibly and is not collected by Cheapseats.com upon purchase.
A $25.00 administrative fee will be charged for travel receipts requested after departure.
Lost Tickets
If your paper airline ticket is lost or stolen, please call the airlines directly for assistance
In most cases, the airlines require you to purchase replacement tickets at “today’s” fare. If your original tickets are not used after a designated period of time—generally 3 to 4 months, depending on the airline—you will receive a credit for the purchase price of the replacement tickets, less the application fee. This fee varies by airline, but is typically $100.00 per traveler. Please note that these policies and fees are subject to change at any time.
White Label Fares
In some cases, certain agreements we have negotiated with an airline require us to conceal the airline name and/or schedule, flight numbers or connection cities until after you purchase the ticket. Once you have purchased your ticket, we reveal the airline in the final itinerary that appears after your reservation has been processed.
These flights are special fares that are NON-REFUNDABLE, NON-TRANSFERABLE AND NON-CHANGEABLE. If you are in any way uncomfortable with the idea that the actual airline information will only be revealed after you have purchased your tickets, select a different flight. However, if you are interested in substantial airfare savings, you should definitely consider these incredible money-saving fares
Shipping
By placing an order, the member accepts the following shipping terms:
Tickets can only be shipped to the Billing address of the credit card holder on whose card the ticket was purchased. We are unable to ship to A.P.O. or F.P.O. addresses, and no C.O.D orders can be accepted.
In order to ensure delivery of your International tickets prior to your departure, we cannot accept bookings for travel within 5 business days of departure date.
All paper tickets must be shipped within the domestic United States. Tickets will be shipped via UPS 2 Day Delivery. A $19.95 USD per ticket delivery fee applies. A $36.00 USD service charge will be assessed for overnight delivery within the continental United States. The charge to Alaska or Hawaii will be $21.50 USD for 2-day delivery. Overnight delivery charge will be $36.00 USD to Alaska and $38.00 USD to Hawaii (when available). The charge will appear on your statement from Cheapseats Network.
HOTEL RESERVATIONS
Prepaid Reservations
Prepaid Reservations are prepaid and your credit card will be charged the Full Base Amount (room only) of the reservation at the time you book. Individual hotels collect payment for per night room tax, resort fees, and cleaning fees, which may be accessed on a daily basis. They also will collect for incidentals such as meals, movies, games, wet bar, parking, and phone calls. These are reservations that must be prepaid because they are discounted rooms. Rates are only guaranteed at the time of booking.
Cancellation policies are as follows, and vary by property. You must request cancellation prior to check in to avoid extensive penalty fees. Cheapseats.com charges $20.00 per reservation to cancel, no matter what the timeframe or reason. This is in addition to any individual rate rules and cancellation policies that are displayed in the "Regarding Your Booking" section on the billing and information page. No reservation can be cancelled after the date of check-in, and guests are responsible for any and all "no show" charges.

Non-Prepaid Reservations
Non-Prepaid Reservations use your credit card to hold your reservation until you arrive for check-in. Cheapseats.com STRONGLY RECOMMENDS that you confirm non-prepaid reservations directly with the hotel, no sooner than 24 hours prior to check-in. These policies can vary depending on location and season.
Cancellations can only be accepted within the specified timeframe that are displayed in the "Regarding Your Booking" section on the billing and information page. Additional hotel refund policies are applicable. No reservation can be cancelled after the date of check-in, and guests are responsible for any and all "no show" charges. Refunds are at the discretion of the hotel and may not result in full refunds. On some non-prepaid hotels, hotel companies require a deposit up to and including the full amount of the stay, which will result in non-refundable cancellations and no modifications allowed.

General Information
Hotel Requests for specific features such as bedding type or non-smoking rooms are simply that, and while most hotels will strive to honor your requests, neither Cheapseats.com nor the hotel guarantee that your request will be honored.
Hotels change pet acceptance policies often and without notice. It is very important that you confirm directly with the property that they do, indeed, accept pets. Cheapseats.com accepts NO RESPONSIBILITY for an individual property's pet policy. You must call the hotel directly to confirm pet policies, including pet restrictions on breeds.
Currency Conversions are based on approximate exchange rates at the time of booking and should be used for an approximate guide only. These rates are approximate base room charges. Individual hotels collect payment for per night room tax, resort fees, and cleaning fees, which may be accessed on a daily basis. They also will collect for incidentals such as meals, movies, games, wet bar, parking, and phone calls.
Some rates have special requirements such as Corporate, Government (including Military), AAA, or AARP membership. These rates will require you to present identification at the time of check-in to prove that you qualify. Hotel properties are NOT obligated to honor these rates if you do not qualify.
Hotel Confirmation
Hotel Confirmations may take up to 72 hours from the time of your booking to confirm. Please note that your reservation is NOT SECURE until you receive final email confirmation from Cheapseats.com. If you do not receive any email communication from Cheapseats.com, please call customer service at 1-800-297-2124 or 702-939-4683 to check on your reservation.
Payment and Sales Tax
Cheapseats.com Travel accepts Discover, American Express, Visa, MasterCard, and Diners Club credit cards for all purchases. All payments must be in US Dollars. Current billing address and phone information must be included with every order. Sales Tax will be charged on certain products depending on the shipping address as required by law. Due to the terms and conditions of our various airline contracts, multiple charges may appear on your credit card statement. Cancellation, change fees, and shipping fees will be additional.

The services of Cheapseats.com are available only to individuals who can form legally binding contracts under applicable law, and thus, are not available to minors. Use of this site also warrants that the user is legally authorized to make the travel reservations or purchases made for either himself or herself or for another person for whom he or she is authorized to act. Use of this site also means that the user agrees to the terms and conditions of purchase imposed by the supplier of travel services (air, land, or sea), which may include, but are not limited to, restrictions against back to back ticketing, hidden city ticketing and round trip for one-way ticketing. The user also agrees to the payment of all amounts when due, including additional taxes and fees that may not be included in the quoted fare, and compliance with all rules regarding the availability of fares, products or services to include penalty fees arising from the failure of the purchaser to comply with said rules. User shall also agree to pay all duties, taxes, and related charges arising out of its use of this Site and of the services provided herein. User also agrees to allow Cheapseats.com to charge the credit card on file for the payment of penalties arising from the purchaser's failure to comply with airline tariff rules. Such payment will be collected without additional notice.
You may only use this site to make legitimate reservations or purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservations, or any reservation in anticipation of demand.
Member Profile
Members provide Cheapseats.com with travel preferences, credit card billing information, and other personal information. This information is primarily used to assist members in making reservations. Furthermore, when you become an Cheapseats.com member you provide your name, address, telephone number, email address, a unique login name, password and password validation. This information is collected on the registration form for several reasons including: (a) personal identification; (b) to complete travel reservations; (c) to allow us to contact you for member service, if necessary; (d) to customize the content of our site to meet your specific needs; and (e) to make product improvements to Cheapseats.com.
In addition, your email address is collected to send you an email message confirming your new member registration and each reservation you transact online. As a member you may occasionally receive updates from us about fare sales in your area, special offers, new Cheapseats.com services, and other noteworthy news items. However, you may always decline to receive these email messages.
At any time, you can view and/or update your personal profile, which includes member registration and travel preferences information, by following the appropriate link on Cheapseats.com's home page.
Privacy and Use of Personal Information
You are in complete control of the information you provide to Cheapseats.com and/or its various third party providers and distributors for your travel planning needs. Cheapseats.com and/or its various third party providers and distributors respects and will continue to respect the privacy of members who use this Site.
When you reserve or purchase travel services through Cheapseats.com, information about you is provided to the airline, car rental agency, hotel or other involved third party to ensure the successful fulfillment of your travel arrangements. Occasionally, Cheapseats.com will hire a third party to act on our behalf for projects such as market research surveys and contest entry processing and will provide information to these third parties specifically for use in connection with these projects. The information we provide to such third parties is protected by a confidentiality agreement and is to be used solely for completing the specific project.

Non-exclusive Right and License to Use

Cheapseats.com collects IP addresses to help diagnose problems with our servers and for system administration.

Cheapseats.com occasionally sponsors contests to give members the opportunity to win prizes. Information collected by Cheapseats.com for such contests can include contact information and survey questions. Online Surveys
Cheapseats.com values opinions and comments from members, so we occasionally conduct online surveys. These surveys are entirely optional for all members. Assignment
You may not assign, convey, subcontract or delegate your rights, duties or obligations hereunder.
Additional Terms
Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and you agree to abide by such other terms and conditions.
Severability
These terms and conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.
Modification
Cheapseats.com may at any time modify these terms and conditions and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your use. Accordingly, you agree to review these terms and conditions periodically, and your continued access, use and/or posting on this site shall be deemed your acceptance of the changed terms, conditions and notices.

This limitation of liability shall apply regardless of whether the claim asserted is based on contract, negligence, or any other theory of recovery.
Indemnification
You agree to indemnify and hold Cheapseats.com and its subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party. Cheapseats.com's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.
Governing Law
This Agreement and its performance shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions, in all disputes arising out of or relating to the use of this website. Use of this website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation this paragraph.
